Kanhaiya Kumar and JNU

Kanhaiya Kumar is former president of JNU union

In February 2016, he was arrested and charged with sedition by the Delhi police for allegedly raising anti-India slogans in a student rally. The rally was called to protest the 2013 hanging of Mohammed Afzal Guru, a Kashmiri separatist convicted for the 2001 Indian Parliament attack. Kumar was released on interim bail on 2 March 2016 for lack of conclusive evidence.

Delhi Police officials were left embarassed by court
Court asked Delhi police if it had any evidence that showed Kanhaiya was raising slogans? To which Delhi Police represented by ASG Mehta said It had none but Kanhaiya was present.
Bench responded “There is a difference between being present and participation,”

Further
1. They failed to register an FIR on the matter when Saurabh Sharma (ABVP) complained against the event
2. They failed to submit video recording as CISF raised doubts about video recording. Police however alleged that they had independent witnesses who had seen Kumar raising anti-national slogans but relied on video recording and Zee TV's footage
3. Further despite SHO and police officials stationed at the gate, they failed to apprehend masked persons who raise slogans OR record any evidence or maintain register of people who attended the function which raised question What was Delhi police doing during the whole incident?

Kapil Sibal representing Kanhaiya questioned the premise of case itself by arguing University was not a public place. Further “How can something happening inside a university campus between two factions incite people outside to create a law and order situation?”

LG and Delhi government had different standpoint with Delhi government arguing doctored video circulated by Zee news and ASG Mehta arguing that the incident had become a rallying point for anti-national movement across India.


Latest update
The Delhi High Court Thursday issued a notice to Delhi Police and asked them to respond to a plea seeking cancellation of bail granted to JNU Students’ Union president Kanhaiya Kumar.

In the interest of justice Court has asked Mr. Mehera arguing for Delhi government and ASG Mehta to submit their stand in written on the matter.
